Kelvis Rodriguez Tormes is identified as the suspect kiler of the Desmond Armond Joshua who was an employee of an east Orange County Burger King.
The Orange County Sheriff’s Office identified the shooter in a news release Sunday as 37-year-old Kelvis Rodriguez Tormes. Authorities said he is charged with first-degree murder with a firearm, destruction of evidence and possession of a firearm by a convicted felon.
Deputies responded to the restaurant at 7:30 p.m. and found Joshua Jr. in the parking lot with a gunshot wound. Joshua Jr. died from his injuries at a Advent Health East Orlando, according to the arrest affidavit.
Rodriquez Tormes was arrested at 3:30 a.m. Sunday after investigators interviewed witnesses that said Joshua Jr. had been working at the drive-through of the Burger King, and a woman who police believe to be Ashley Mason, who was also later detained, became irate while waiting on an order as the drive-through had become backed up.
Witnesses said the woman exited a vehicle and continued to “yell and threatened to bring her ‘man’ to the restaurant,” the affidavit stated. The woman was refunded her money for her order and told to leave. Witnesses said the woman, who was driving a sedan waited in the parking lot for about five minutes, left for about two minutes and returned along with a white truck driven by a man about two minutes later.
The affidavit said Rodriquez Tormes was later identified as the driver of the truck, and he exited the vehicle and demanded to fight Joshua Jr .. A fight ensued during which Rodriquez Tormes placed Joshua Jr. into a headlock and began to choke him. Another person helped break up the fight, but then a witness saw Rodriquez Tormes arm himself with a handgun, enter into the driver’s seat of the truck and “overheard him state, ‘You got two seconds before I shoot you,’” the affidavit states .
Witnesses heard a shot and saw Joshua Jr. fall to the ground as both the white truck and sedan fled the scene. Investigators made the arrest of Rodriquez Tormes and also detained Mason after witnesses identified the two as the man and woman involved in the fight.
The affidavit stated Rodriquez Tormes was found to be a convicted felon and states he dismantled the gun used to shoot Joshua Jr. and hid it in an unknown location.
