The Democratic-led panel on Tuesday received approval to hire two “special oversight counsels” — Norm Eisen, a former ethics official in the Obama administration, and Barry Berke, a New York-based defense attorney.

Berke has worked for Kramer Levin for several years and is now partnering with the premier law firm in New York City. In addition to his legal work, Berke was also an associate professor of law at the University of New York. He was involved in the American College of Trial Lawyers and Federal Defenders of New York Inc.
Berke is best known for defending high profile defendants. In 2011, he successfully defended a former Deutsche Bank broker accused of marketing fraudulent tax homes. It was one of the largest cases of tax fraud in the history of the United States.

“In the legal circles of New York, Barry’s performance in this process was a real event,” Paul Schoeman, another lawyer who worked on the case, told The New York Times. “He is really creative and inventive in his thinking and combines this with incredible preparation and hard work. It is not just a good idea. It is well executed.”
According to his law firm, Berke, “former SAC Capital Fund Advisors fund manager Michael Steinberg represented in a well-known case of insider trading that was closed by US prosecutors after the United States Supreme Court ruled that there was no decision in a related case Review of Circuit 2 This was in line with the arguments presented by Kramer Levin in the Steinberg case, and held that the government had exceeded the limits of the Privileged Information Trade Act when it tried to prosecute to the distant Tippees. ”

Lawyers who will be Heard from in Second Impeachment Hearing
Testimony will be heard from the attorneys for the Democrats, Daniel Goldman, and the Republicans’ lawyer, Steve Castor. Barry H. Berke and Castor will provide opening statements for the majority and minority, respectively, according to a statement from the Judiciary Committee on Friday.

Second Impeachment Hearing
He has served as the special oversight counsel to the committee since February, working to build the investigative framework that now appears destined to end in the impeachment of Mr. Trump. On Monday, he will take a rare turn at the witness table to present for 30 minutes the facts before the committee and how they square with the law.
“The House Judiciary Committee is determined to ask critical questions, gather all the information, judiciously assess the evidence, and make sure that the facts are not hidden from the American people,” Nadler said in a statement. “I am glad to have such valuable resources available to help us ensure that this Administration is held accountable to our laws and to the American public.”
Committee officials stress that the new hires should not be seen as the precursor to impeachment. But the issues they will be focused on — abuses of power, the rule of law and obstruction of justice — could well produce threads that lawmakers could use to lay the groundwork for that.
