Virginia prosecutors said Thursday that two federal police officers were prosecuted for the 2017 murder of a 25-year-old driver after a brief chase.

 

US Park Police officers Alejandro Amaya and Lucas Vinyard have been charged separately. Fairfax County Commonwealth Attorney Steve Descano said at a press conference that each of them faced involuntary manslaughter and reckless firearm evacuation.

 

Amaya and Vinyard shot Bijan Ghaisar on November 17, 2017 after trying to stop them in Alexandria. Previously, Ghaisar had left an accident scene; someone else hit his vehicle.

 

“Bijan Ghaisar was a person who was involved in a minor car accident and was shot and killed by law enforcement within minutes,” Descano said. “He left a family at a great loss and a community with many unanswered questions. Today, we are one step closer to the answers.”

Dashcam footage of the footage shows Ghaisar stopping after a car chase at George Washington Parkway. As the car slowly starts towing again, a few shots are heard.

 

WRC-TV reported that officers had given Ghaisar, an unarmed accountant, numerous chances to stop, and feared it would endanger themselves and others.

 

Ghaisar’s family said in a statement that they were pleased that the authorities decided to file a criminal complaint.

 

“Our hearts are a little lighter tonight, knowing that the police officers who killed our son and brother are closer to being held responsible for their actions,” the statement said.

The indictments came after federal prosecutors refused to pursue charges against officials after nearly two years of investigation. Descano said that his office had to rely on evidence gathered by the Fairfax County Police Department after the Justice Department refused to cooperate or extract witnesses.

 

He said he expects the Justice Department to take the case to federal court within 30 days. He said federal prosecutors would likely propose dismissing the case based on the Constitutional supremacy clause, which says federal laws prevail over state law.

 

Descano said his office has partnered with Virginia Attorney General Mark Herring to address substance-related issues.

 

“Because of these unique challenges, we were not just preparing for these indictments, we were preparing for the trial for months,” he said. “I know we are ready to try this case tomorrow, standing in front of you.”

 

Both officers face up to 15 years in prison. Ghaisar’s family filed a civil suit regarding his death.

 

The Park Police unit is a unit of the National Park Service that has jurisdiction over all federal parks.
